These Terms of Service ("Terms") apply when you use homeax.shop (the "Site") or purchase products from Homeax ("HOMEAX", "we", "us", or "our"). Please read them before placing an order. These Terms form a contract between you and HOMEAX when we accept your order as described below.
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited, including mandatory consumer rights in your country.
1. About HOMEAX and These Terms
HOMEAX operates this online store. Shopify provides the commerce platform that enables us to offer products and Services, but your contract for a HOMEAX product is with Homeax at the contact details above.
By using the Site or placing an order, you agree to these Terms and the commercial policies expressly incorporated into them. Our Privacy Policy separately explains how we process personal data; it is a notice and does not create consent where another lawful basis applies. If you do not agree to these Terms, do not use the Site. Headings are for convenience and do not affect interpretation.
2. Eligibility and Consumer Use
You must have legal capacity to enter a contract. If you are under the age of legal majority where you live, a parent or guardian must place the order or approve your use where lawful. The Site is intended primarily for consumers purchasing products for personal use. If you buy wholly or mainly for business purposes, please contact us before ordering because different mandatory rules may apply.
3. Accounts and Information You Provide
You may need to provide accurate, current, and complete contact, billing, and delivery information. You are responsible for keeping account credentials confidential and for activity you authorise through your account. Tell us promptly if you suspect unauthorised access.
We may suspend access where reasonably necessary to protect you, other users, or the Site, investigate misuse, or comply with law. We will act proportionately and, where appropriate, explain the reason.
4. Products and Availability
We take reasonable care to describe and display products accurately. Colours and appearance may vary slightly because of screen settings, lighting, or normal manufacturing variation. Measurements are approximate unless stated otherwise. These variations do not affect your rights where a product is faulty, materially different from its description, or otherwise does not conform to the contract.
All products are subject to availability. Adding a product to your basket does not reserve it. We may limit quantities on a reasonable, non-discriminatory basis, including to prevent fraud or resale abuse.
5. Prices and Charges
Prices are shown in the currency selected on the Site and may change before an order is placed. The total displayed at checkout is the amount payable for the products and standard delivery. Standard delivery is free for supported destinations.
Customers will not be required to pay additional shipping charges, import VAT, customs duties, customs-clearance fees, or other mandatory import charges on delivery. If a carrier or authority unexpectedly requests such a charge, contact support@homeax.shop before paying and see our Shipping & Delivery Policy.
6. How the Contract Is Formed
When you submit an order, you make an offer to buy the products in that order. An automated order confirmation acknowledges receipt but does not by itself mean that we have accepted the order. We accept the order, and the purchase contract is formed, when we send dispatch confirmation or dispatch the product, whichever occurs first.
Before acceptance, we may decline or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing or description error, inability to authorise payment, an unsupported delivery address, suspected fraud, or a legal restriction. We will notify you and promptly release or refund any amount taken. If only part of an order is accepted, the contract applies only to that part.
If a pricing error is obvious and could reasonably have been recognised as an error, we may contact you before acceptance to offer the correct price or cancel the affected item. After acceptance, we will not unilaterally increase the agreed price or materially reduce your contractual rights.
7. Payment
Available payment methods are shown at checkout. You authorise us and our payment providers to charge the amount displayed. Payment may be authorised when you order and captured before or at dispatch, depending on the method used. You confirm that you are authorised to use the selected payment method.
If payment is reversed, rejected, or reasonably suspected to be unauthorised, we may pause or cancel the affected order, subject to applicable law.
8. Delivery
Delivery destinations, processing times, estimates, tracking information, and rules for delays or missing parcels are set out in our Shipping & Delivery Policy, which forms part of these Terms.
Delivery dates are estimates unless we expressly agree a guaranteed date. We remain responsible for the goods until they are delivered to you or a person you identify to receive them, except where applicable law provides otherwise because you independently commissioned a carrier not offered by us.
9. Cancellation, Returns, Exchanges, and Refunds
Our voluntary 30-day return window, return conditions, exchanges, costs, statutory cancellation information, and refund timing are explained in our Returns & Exchanges Policy, which forms part of these Terms.
That policy is additional to your mandatory legal rights. In particular, qualifying UK and EEA consumers may have a statutory right to cancel many online purchases within 14 days after delivery, subject to legal exceptions. To exercise a right or request a return, email support@homeax.shop with your order details and a clear statement of your request.
10. Faulty or Non-Conforming Products
Products must meet all mandatory standards and contractual requirements that apply to your purchase. If a product is faulty, unsafe, damaged on arrival, incorrectly supplied, or not as described, contact us promptly with the order number and reasonable evidence of the issue.
Depending on the circumstances and applicable law, you may be entitled to repair, replacement, price reduction, rejection, or refund. For consumers in the European Union, goods are generally covered by a minimum two-year legal guarantee of conformity. Nothing in these Terms or a manufacturer's warranty restricts a statutory guarantee or remedy.
11. Promotions and Discount Codes
A promotion may have additional terms displayed with the offer. Unless stated otherwise, promotions are available for a limited period, cannot be exchanged for cash, cannot be combined, and apply only to eligible products and customers. We may refuse misuse, automated participation, fraud, or a breach of the published promotion terms, but will not remove a discount already included in an accepted order without a lawful reason.
12. Intellectual Property and Permitted Use
The Site and its content, including text, graphics, logos, photographs, video, layout, and software, are owned by or licensed to HOMEAX and protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for lawful personal shopping and information purposes.
You may not copy, reproduce, distribute, sell, scrape, reverse engineer, or commercially exploit the Site or its content except as permitted by law or with prior written permission. Nothing in these Terms prevents legally permitted quotation, review, interoperability, or other use that cannot lawfully be restricted.
13. Acceptable Use
You must not use the Site to:
- break the law or infringe another person's rights;
- submit false, fraudulent, abusive, defamatory, discriminatory, or unlawful material;
- introduce malware, probe vulnerabilities, interfere with security, or disrupt the Site;
- impersonate another person, conceal unauthorised activity, or make an unauthorised purchase; or
- collect personal data about others without a lawful basis.
We may take proportionate action, including removing content or restricting access, where we reasonably believe this section has been breached.
14. Reviews and Other Content You Submit
You retain ownership of content you submit. You grant HOMEAX a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, translate, display, and distribute that content only as reasonably necessary to operate, improve, and promote the Services and products. This licence lasts while the content is used for those purposes, subject to your privacy and other legal rights.
You confirm that you have the necessary rights to submit the content and that it is honest and lawful. We may moderate or remove content for legitimate reasons, including illegality, infringement, personal data exposure, spam, or a conflict of interest. We do not promise to publish every submission.
15. Third-Party Services and Links
The Site may contain links to or integrations with services controlled by others, including payment, social-media, and delivery services. Their own terms and privacy notices apply when you use them. A link does not mean that HOMEAX endorses every statement or service on the third-party site. We remain responsible for our own obligations and cannot exclude liability where the law makes us responsible for a service provider acting on our behalf.
16. Website Availability and Information
We aim to keep the Site available and information current, but maintenance, faults, security events, or circumstances beyond reasonable control may cause interruption. We may correct typographical or technical errors and update general Site content. Changes will not retrospectively alter an accepted order unless agreed with you or required by law.
17. Our Responsibility to Consumers
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was formed.
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory consumer rights, or defective products where liability cannot be excluded.
If you are a consumer, we are not responsible for business losses, including lost profit, revenue, business opportunity, or business interruption, because the products and Site are supplied for private use. Nothing here affects a remedy that applicable consumer law gives you.
18. Events Outside Reasonable Control
We are not responsible for delay caused by an event outside our reasonable control, provided that we take reasonable steps to minimise the effect and notify you where the delay is material. If the risk of substantial delay occurs, you may contact us to cancel the affected order and receive a refund for products paid for but not delivered, where applicable law or these Terms gives that right.
19. Suspension and Termination
You may stop using the Site at any time. We may suspend or terminate access for a serious or repeated breach, fraud, security risk, or legal requirement. Where reasonable, we will give notice and an opportunity to correct the issue. Termination does not cancel an accepted order or remove accrued rights unless the order is separately cancelled under these Terms or applicable law.

Our collection and use of personal data is explained in our Privacy Policy. Cookie choices are available through the privacy controls on the Site.
21. Changes to These Terms
We may update these Terms for future use of the Site or future orders, including to reflect legal, security, technical, or business changes. The version in force when we accept an order governs that purchase unless a change is required by law or you expressly agree otherwise. We will post the updated Terms and change the "Last updated" date; material changes will receive any additional notice required by law.
22. Governing Law and Courts
These Terms and contracts with HOMEAX are governed by the laws of England and Wales.
If you are a consumer outside England and Wales, this choice does not deprive you of mandatory protections provided by the law of the country where you habitually live. You may bring proceedings in the courts available under applicable consumer law, including the courts of your home country where those rules permit. HOMEAX may bring proceedings against a consumer only in a court permitted by mandatory law.
23. Complaints and Dispute Resolution
Please email support@homeax.shop with your order number, a description of the issue, and the outcome you seek. We will acknowledge and investigate complaints within a reasonable time.
You may also have access to a consumer-protection authority, alternative dispute-resolution body, or court in your country. We are not committed to using a particular alternative dispute-resolution provider unless we expressly confirm otherwise or applicable law requires it.
24. General
If a court or competent authority finds part of these Terms unlawful or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. You may not transfer your contract without our agreement, except where the law allows. We may transfer our rights or obligations only if this does not reduce your protections; we will notify you where required.
Only you and HOMEAX have rights under these Terms, except where applicable law gives rights to another person. These Terms, together with the order confirmation and policies expressly incorporated into them, contain the agreement for your purchase, without excluding statements or rights that cannot lawfully be excluded.
